Criminal Defense Attorney, Christopher Lee of Wallin & Klarich, Assists Client to Avoid Jail Time by Getting Sentence for Charges of Possession of a Deadly Weapon Reduced

A Wallin & Klarich client, who was charged with possession of a deadly weapon, recently had his sentence reduced to community service instead of jail time. The client was represented by knowledgeable and experienced Orange County criminal lawyer, Christopher Lee.

My client was at the wrong place at the wrong time, said Mr. Lee. I negotiated with the prosecution and convinced them that there is a distinction between a person possessing a deadly weapon ready to do harm or evil and a person maintaining a weapon for self defense.

According to court record from Orange County Superior Court Central Justice Center, the incident began when the client fell asleep in his car in the parking lot of his place of employment. The client had a substantial commute and in order to get to work on time and avoid traffic would many times arrive early to work and rest in his car prior to his work shift. After noticing that the client was asleep in a parked car, a worried nearby neighbor called the police claiming there was a suspicious vehicle and possible burglar in the area. When the police arrived to investigate the claims made by the neighbors call, they searched the interior of the clients vehicle and found a collapsible baton. Consequently, the client was arrested and taken into custody for possession of a deadly weapon.

After being charged with possession of a deadly weapon the client faced a maximum sentence of one year in the county jail and $ 1,000 in fines according to court documents. In addition to the maximum sentence, the client faced a mandatory sentence of 60 days in the county jail. Attorney Christopher Lee, committed to earning the best possible outcome for the client in the case, quickly gathered information related to a defense. Mr. Lee provided the District Attorney with the full facts of the case and presented evidence that the client kept the baton in his car in case he needed it for his own protection. Mr. Lee also provided evidence that this was a reasonable concern for the client, as the clients home had recently been broken into on two separate occasions.

After negotiating with Mr. Lee and learning the behind the scenes facts of the case, the District Attorney offered community service labor as the sentence for the charges against the client according to court record. As a result, the client was able to avoid spending at least 60 days in the county jail and was only required to complete 24 hours, or three days of community service labor.
